We granted a hearing in this case in order to resolve a conflict between Court of Appeal opinions in this and earlier cases. (Compare In re Richard W. (1979) 91 Cal. App. 3d 960 [155 Cal. Rptr. 11], with In re Ruben M. (1979) 96 Cal. App. 3d 690 [158 Cal. Rptr. 197].) After an independent study of the issue, we have concluded that the thoughtful opinion of Justice Wiener for the Court of Appeal, Fourth Appellate District, in this case correctly treats the issues and that we should adopt it as our own.
